The Villeneuve Friesen Pit is considered a “non-conforming use” as per section 643 of the Municipal Government Act. This means the operation complies with the rules and regulations in place when it was started. The operation may continue to operate in its current capacity. For this pit, stockpiles can be sold off and reclamation can occur; however, aggregate material cannot be brought on-site. Note: a non-conforming use cannot be expanded upon or have any new buildings constructed on the parcel without coming into compliance with the current Land Use Bylaw.
