This is an agreement between Sturgeon county and the landowner, tenant, resident as indicated and signed in the agreement below.

This agreement is applicable to the Sturgeon County Vegetation Management Program.

Sturgeon County recognizes the fact that some landowners/tenants are not in favor of having municipally owned roadside ditches adjacent to their property treated with herbicides for weed control.

The terms of this agreement are as follows:

  1. Sturgeon County shall advertise by way of newspaper the deadlines for Limited Control Area Agreement completion. Advertising will be done for a period of three consecutive weeks prior to commencement of herbicide application activities.
  2. Limited Control Area Agreements must be completed by landowners/tenants prior to May 3, 2024.
  3. This agreement applies to municipally-owned lands and road allowances directly adjacent to parcels of land identified on the back of this agreement.
  4. Only the landowner or occupant may complete a Limited Control Area Agreement for their property.
  5. Sturgeon County shall issue a sufficient quantity of approved ‘No Spray’ signs to those who complete a Limited Control Area Agreement. Whenever possible, landowners will reuse signs that have been previously issued, provided that they are legible and in good condition.
  6. Landowners/tenants shall ensure that all signs are posted by May 3, 2024. Signs shall be posted as instructed by the authorizing Agriculture Services Representative.
  7. Limited Control Area Agreements will be observed only for the program(s) identified above.
  8. Sturgeon County will not be responsible for the work performed by other vegetation management companies hired by third-parties (ie, Fortis) who operate on municipal lands.
  9. The landowner/tenant accepts responsibility for all vegetation management required in the area specified in this agreement. At a minimum, the requirements of the Alberta Weed Control Act must be maintained. This includes: the control of weed designated as ‘Noxious’ and the destruction of plants designated as ‘Prohibited Noxious’.
  10. Sturgeon County will inspect all areas for which a Limited Control Area Agreement has been completed on or after July 12, 2024 to ensure that landowners/tenants are meeting the weed control requirements specified in this agreement.
  11. If it is determined that the landowner/tenant has failed to maintain the required weed control standards, they will be contacted and reminded of the terms of this agreement. They will be given five working days to remedy the situation. If control has not taken place during that period, Sturgeon County will arrange to have the deficiency addressed by the method deemed most effective for control by the appointed Agricultural Fieldman. This which may include herbicide application.
  12. Organic growers must provide a buffer zone on their own property separate from and not including the municipal road right-of-way.
  13. Sturgeon County shall maintain the right to refuse to enter into this agreement with any landowner/tenant who has failed to uphold the terms of this agreement in previous years.
  14. The terms of this agreement expire on October 31, 2024. It is the responsibility of the landowner/tenant to complete a new agreement annually.
